Devmastr Discovery Terms
Devmastr is a business name of RW Media Pty Ltd (ABN 82 623 586 372), registered in Victoria, Australia ("Devmastr", "we", "us").
These terms apply when you Accept them in the Portal and pay for Discovery. Capitalised words have the meanings in our Definitions, published with these terms.
1. What Discovery is
1.1 Discovery is a paid, fixed-scope planning stage. We learn how your business works, define what to build, and work out what it will cost. 1.2 It includes workshops, a review of your current systems and workflows, requirements and user flows, low-fidelity wireframes of key screens, a technical and hosting plan, and a fixed Quote with a Milestone plan. The tier's inclusions are shown on your Discovery invoice. 1.3 Discovery does not include building, coding or final visual design (prototypes only if quoted for a Platform Discovery).
2. Fee and payment
2.1 Fees (ex GST): Website $950 · System $2,500 · Platform from $6,000 (the fee is confirmed before you pay). 2.2 The Discovery fee is paid 100% upfront. The invoice is due within 14 days. An unpaid Discovery offer lapses after 30 days. 2.3 GST is added where it applies.
3. Timing
3.1 We start Discovery (pre-work and kick-off) only once you have Accepted these terms in the Portal and paid. Paying without accepting doesn't start Discovery; we'll ask you to accept first. We book your kick-off once you have also completed the pre-work questionnaire. The timeframe starts at kick-off. 3.2 Typical length: Website 2–3 Business Days; System and Platform 1–2 weeks (longer for a Platform if agreed before you pay). 3.3 The clock pauses while we are waiting on you. If you don't respond for 30 days, we may close Discovery and deliver what is complete. 3.4 If the work turns out to need a larger tier, we'll tell you and Devmastr Accounts will invoice the difference. Discovery pauses until it is paid. Or you can choose to stop; we deliver the work done so far and no further fee is payable.
4. What you receive
4.1 At the end of Discovery you receive the Discovery Report and a fixed Quote for the build. The Quote is valid for 30 days from issue. 4.2 Once the Discovery fee is paid, you own the Discovery Report. You may use it with another developer. Our Pre-existing Material stays ours. 4.3 One round of revisions to the Discovery Report is included, if you request it within 10 Business Days of it being published. 4.4 Changes after that window are a paid Discovery extra: hours at the Base Rate, minimum 2 hours, rounded up to the nearest $50, invoiced upfront. Extras don't count towards the build credit.
5. Build credit
5.1 If you Accept the build Quote within 30 days of it being issued, 50% of the Discovery fee (including any top-up, excluding extras) comes off your first build invoice. 5.2 If we issue a revised Quote while the current one is still valid, the 30 days restart from the revised Quote. A Quote re-priced after it expires carries no credit. 5.3 Building with us requires our Master Services Agreement, signed electronically before the first build invoice.
6. No obligation
Paying for Discovery doesn't oblige you to build with us. It doesn't oblige us to accept a build we believe is unlawful, unsafe or not a good fit.
7. Cancellations and refunds
7.1 You may cancel before your kick-off for a full refund. 7.2 Once Discovery has started, the fee is not refundable, because the time is committed. We deliver everything completed up to the point you cancel. 7.3 If we cancel Discovery for any reason other than your breach, we refund the fee for work not delivered.
8. Your responsibilities
8.1 You give us accurate information and timely access and answers, and make sure someone who can make decisions attends the workshops. 8.2 You are responsible for your business complying with the laws that apply to you wherever you operate. We give technical advice only, not legal advice. 8.3 We may stop Discovery if we reasonably believe the project is unlawful, harmful or unsafe, and refund the fee for work not delivered.
9. Confidentiality and privacy
We keep what you share confidential and use it only to plan your project. Personal Information is handled under our Privacy Policy.
10. Liability
10.1 To the extent the law allows, our total liability for Discovery is limited to the Discovery fee you paid, and we are not liable for indirect or consequential loss or lost profits. 10.2 Nothing in these terms excludes rights you have under the Consumer Law.
11. General
11.1 Accepting these terms in the Portal is binding, with the same effect as a signature. We record the version, time, user, IP address and document hash. 11.2 Governed by the laws of New South Wales, Australia. 11.3 Notices: to us at [email protected]; to you at the email on your Portal account.
